Current Holmes County Sheriff Dennis Lee has been in office for more than seven-years, and the November 2000 election is still not decided.
Former sheriff John Braxton had challenged the election results in circuit court and lost.
The District Court of Appeals in Tallahassee says there was no fraud or negligence in the ballot count, but there still may be some bad news for Sheriff Lee. The appeals court says the lower court should have considered all the evidence before rejecting 25-absentee ballots.
The court also ordered 14 presidential under votes recounted to see if there are any sheriff votes on them and 3 spoiled ballots will also be counted.
