Geneva County Probate Judge Harry Adkinson removed himself from hearing the case of a town, which has never held an election since its reincorporation in 1957.
A group of Geneva County residents is seeking forfeiture of the town of Eunola's Charter.
That's because Alabama law states all cities and towns must hold elections.
For nearly 50-years, Eunola's mayor and council members have appointed city residents to fill vacancies.
Since Probate Judge Adkinson is also the Geneva County commission chairman, it was ordered that the office of courts in Montgomery be notified.
That department is expected to appoint a probate judge from an Alabama county to hear the case of whether Eunola's Charter should be dissolved.
There's no word on when that appoint will be made.
