A former death row inmate from Dothan has regained the right to appeal his latest conviction.
Fifty-one-year-old Jerry Hammond was twice convicted and sentenced to die for the 1988 murder and robbery of his elderly uncle, but the case kept getting overturned on appeal until finally, Hammond was sentenced to life in prison without parole last December.
Defense attorneys also appealed that case, but court records indicated they missed the legal deadline. However, during a hearing Wednesday, attorneys proved they did file their motion on time but the case was not properly recorded because of a clerical error.
If Hammond gets another trial, he can never be sentenced to more than life without parole again and there's always a chance he could be found not guilty.
