Currently, most custodial parents are free to move when and where they want. However under the new Alabama Parent-Child Relationship Protection Act, which goes into effect on Monday, custodial parents will have to notify the other parent 45 days before relocating.
The other parent has a month to object and can file a lawsuit to stop moves across state lines or in-state moves that are more than 60 miles away. However, the new law does not apply to victims of domestic violence or to moves required by military order.
Some attorneys are objecting to the new law, saying that it may be unconstitutional.
