Smith Jury

A condemned killer's new lease on life has Houston County court officials conducting an unusual search. They're trying to reassemble the original jury to resistance a convicted killer.

The panel convicted 32-year-old Jerry Jerome Smith and recommended the death penalty five years ago.

Smith was found guilty in 1998 of the 1996 murders of three people at a Dothan drug house.

Police say the home on Sturgeon Court served as a crack house and the victims were shot during an argument over drugs and money.

A state appeals court has ordered Smith to be re-sentenced on the grounds that jurors were not allowed to hear evidence that might have convinced them to spare his life.

Court officials want members of the original jury to re-sentence Smith because the panel is already familiar with the case.

Otherwise, a new jury will have to be seated, and Smith will basically have to stand trial again to re-establish his guilt, which is not in question.

The sentencing hearing is set for Dec. 8.
