An accused killer from Barbour County who was freed by mistake is back behind bars.
23-year-old Tim Foster was captured at his sister's home near Troy Tuesday morning.
He was freed by the state prison system Sunday after serving time for robbery. But he was also still waiting to stand trial for capital murder and should have been returned to the Barbour County jail in Clayton.
Foster escaped from the jail in April but was re-captured later that same day.
That’s when authorities revoked his probation on a robbery charge and sent him back to prison to finish serving his sentence.
Foster is charged with killing one man and wounding another in Eufaula in December of 2004.
