Uninsured Motorists

Motor vehicle insurance is a "must have" in Alabama and has been since June 1, 2000. But new research shows that the number of uninsured drivers on the road is on the rise.

So what happens if an uninsured driver causes an accident involving an insured driver and who pays the bills?

Although Alabama law makes it clear that drivers must have "automobile liability insurance," drivers can refuse to accept additional coverage offering protection against uninsured and under insured drivers.

When an insured driver is involved in an accident with another driver who doesn't carry insurance, the insured person can file a claim with the insurance company and that company will pay the claim up to the amount of the policy limits.

But the insured driver must have uninsured motorist coverage included as part of their liability coverage required by the state.

For people who choose not to add uninsured motorist coverage to their policy, then collecting damages from an uninsured driver found at fault in an accident becomes a civil matter.
