Lawyers for a Wiregrass man charged with capital murder say their client can't get a fair trial in his hometown.

Richard Jenkins is charged in the fatal shooting of Michael Brown in a Geneva neighborhood.

His defense team says there's been too much pre-trial publicity.

If convicted, Jenkins could face the death penalty.

Authorities say Jenkins shot Mr. Brown inside the victim's car in March, 2004.

The shooting was reportedly over drugs.

Circuit Judge Ben McLauchlin is expected to rule on whether to move the trial this week.
