Judge Lawson Little has rejected defense attorneys request to delay the trial of Tierra Gobble.
Gobble was arrested in December and charged in the death of her four-month-old son, Phoenix Cody Parrish.
Defense attorney Tom Brantley says he wants to delay the trial so as the defense can locate witnesses and documents.
Little says the defense has had time to prepare for trial and a delay will not be given.
If Gobble is convicted of capital murder, she could be sentenced to death or to life in prison without parole.
The trial is set for Sept. 12.
