A lawyer for a Wisconsin man charged with killing a Panama City Beach police officer doesn't want jurors to hear anything about the suspect being in a gang.
Prosecutors say they should be allowed to present evidence at trial that 23-year-old Robert Bailey of Milwaukee belonged to the Simon City Royals.
The alleged gang membership could become a factor in whether Bailey is eligible for a death sentence.
Trial is set for January 30th for Bailey who is charged with the first-degree murder of Sergeant Kevin Kight.
Kight was shot to death during a traffic stop last year during Spring Break in Panama City Beach.
