Tuesday a condemned killer with a new lease on life will return to a Dothan courtroom.
Dennis McGriff's death sentence was overturned on appeal by the Alabama Supreme Court last December.
He was convicted of gunning down a Houston County man in October of 1996.
A jury found McGriff guilty of killing Michael McCree during a drive-by shooting.
The same panel also recommended the death penalty on a 10-2 vote.
But late last year, Alabama’s highest court ordered a new trial, saying the original jury was not properly instructed before beginning deliberations.
A pre-trial hearing in the case is set for Tuesday.
