A Dothan woman charged with capital murder in the death of her own baby was back in a Dothan courtroom today.
19-year-old Shakira Thomas claims she should not be charged with a capital offense but News-4 reports the suspect's own words may have already convicted her.
The defense and prosecution agree that Thomas gave birth to a baby girl on July 12. The infant's body was found just over a week later in a garbage bag behind the home that Shakira shared with her parents. Defense attorneys claim the young mother was only six months pregnant when she had a miscarriage.
But police say Shakira told them the baby was full-term and while she originally claimed the child was still-born, she later changed her story and in a taped statement to police, Shakira admitted to letting the baby die.
The defense will try to prove that Shakira's baby could not have survived under any circumstances. The prosecution will try to convince a jury that the young mother intentionally caused her baby's death.
Judge Lawson Little denied a defense motion to suppress the defendant's statement and bound the case over to a grand jury. Thomas is still being held without bond in the Houston County Jail.
