A decision on who tries the sniper suspects first may hinge on where a death sentence can be most easily obtained.
Attorney General John Ashcroft said he's working with the FBI and state officials in reaching a decision. A decision will be made after determining who has the most evidence and the strongest death penalty law.
John Allen Muhammad and John Lee Malvo have been accused of shooting 17 people in Alabama, Louisiana, Maryland, Virginia, Washington state and Washington, DC. Twelve of them were killed.
In Alabama, the two are charged with capital murder in the Sept. 21 murder of Claudine Parker, who was slain outside a state-run liquor store in Montgomery.
