A condemned killer with a new lease on life heads back to court in Dothan Monday.
Thirty-three-year-old Jerry Jerome Smith has spent the past six years on Alabama’s death row.
He was sentenced to die for killing three people during an argument at a Dothan drug den in 1996.
But last year, an appeals court ordered Smith re-sentenced because jurors were not allowed to hear evidence that might have convinced them to spare his life.
Smith’s guilt is not in question, but a new jury will be chosen to recommend life without parole or the death penalty. Jury selection begins Monday at the Houston County Courthouse.
