She's in, she's out, she's in again -- for at least another day at the Miss America pageant.

A federal judge has reversed himself and said he will hear Rebekah Revels' argument as to why she should be allowed to compete as Miss North Carolina.

U.S. District Judge James Fox initially refused to grant Revels' request that he make the pageant recognize her as North Carolina's representative. But then he reversed himself and set a hearing for Tuesday.

Revels said she was forced to resign after a former boyfriend came forward with topless photos.

A state court judge issued an order last week restoring the title to Revels -- but that order expires Wednesday. In the meantime, both Revels and the North Carolina pageant's first runner-up are taking part in the preliminary events in Atlantic City.
