Second Shooting at Club Primetime raises 'Shutdown' Questions
Over the weekend two people were shot outside a Dothan nightclub. It's the second shooting at club Primetime in less than a month.

DOTHAN--The man police say did the shooting is behind bars, but concerns are growing over whether the nightclub is safe and whether it should be forced to close.

24-year-old Tavis Banks is behind bars after shooting two people outside club Primetime over the weekend.

Early Saturday morning police were called to the club for a firearm assault.

Investigators say banks and one of the victims got into a fight inside the club and continued to fight outside.

Banks reportedly went to a car to get a gun.

Police say he fired at least three shots at the victim, hitting him in the leg.

A bystander, who police say wasn't involved in the fight was also shot in the arm and leg.

Both victims were treated at the hospital for moderate injuries.

Banks was later arrested.

Although the alleged shooter is off the streets there are concerns about safety at the club.

"Anytime there is numerous shootings or violent incidents at one location in a short amount of time certainly that is a concern for the police department," said DPD Sgt. Rachel David.

But the police department doesn't have the authority to shut the club down.

"We work with other agencies here in the Wiregrass area that look specifically at bar scenes. Anywhere that has alcohol served there's other governing agencies that work in conjunction with us to look at the safety of things going on in that area."

I spoke with an agent with the Alabama Alcoholic Beverage Control Board, he says a hearing has been scheduled for the club owner before the commission board in Montgomery.

At the hearing the board will determine if the club's liquor license will be revoked, which could result in club Primetime closing.

Investigators believe the club owner plans to voluntarily shutdown.

Banks is charged with attempted murder and 1st degree assault.

His bond is set at $600,000.
