MODESTO, Calif. (AP) - A federal judge says a California man is
free to preach the Gospel in a public square while his lawsuit
against the city of Modesto moves forward in court.
The Alliance Defense Fund filed suit on behalf of Kevin Borden in July to challenge the city's ban on him preaching outside a movie theater in Modesto's Tenth Street Plaza on Saturday evenings.
The city blocked his preaching there for 10 months by claiming that the private business was renting the plaza, making it akin to private property.
On Wednesday, a federal judge granted a motion allowing Borden to preach there as the case advances.
