PHILADELPHIA (AP) -- Prosecutors say they'll appeal a judge's decision to drop three felony charges against a Philadelphia priest accused of molesting a boy in 1997.
The Rev. Andrew McCormick still faces an October trial on indecent assault and other misdemeanors.
Municipal Judge Karen Yvette Simmons said she couldn't uphold sexual-assault charges after hearing the accuser testify Thursday.
Prosecutors strenuously disagree.
Defense lawyer William Brennan questions whether the accuser is jumping on "the gravy train" to sue the Philadelphia archdiocese.
The 24-year-old accuser does not currently have an abuse lawsuit pending.
The 56-year-old McCormick remains free on bail, and on leave from the church.
