May 4, 2012 - Thomas Bice Responds to U-S Departments Letter "Prior to the beginning of the 2011-2012 school year, Alabama’s local school systems were provided with guidance related to enrollment of all students beginning on or after September 1, 2011. This guidance included a request for an original or certified copy of the student’s birth certificate. The guidance further stated that if a student did not have an original or certified copy of a birth certificate or if the birth certificate was issued from another country, school personnel would provide the parent or guardian with additional guidance for supplemental documentation needed for enrollment purposes. The guidance clearly stated that regardless of the available documentation all students would be enrolled and coded in Alabama’s statewide student data management system as either “enrolled with a birth certificate” or “enrolled without a birth certificate”, to be used solely for state department of education reporting purposes based on the reporting requirements included in Section 28 of Act No. 2011-535 and that at no time would this reporting include personally identifiable information. Any negative effect on student attendance or withdrawal was minimized by applying this process to all students and only those enrolling after September 1, 2011, which was several weeks after the official beginning of the school year. All students who were currently enrolled students were unaffected by the revised enrollment criteria. Currently, the provisions of Section 28, along with other provisions of the law have been enjoined by the court. As a result, the modifications made to the enrollment process described above were never implemented." |
